He had to arrest communists in order to obtain the majority in the Reichstag to - legally - suspend the constitution by okaying the Enabling Act. All the more reason why constitutions should have clear and readable limits on government power, so that average citizens can and will say: you're a nice guy Mr. President, but you cannot do this or that!
